Chapter 7 is the quickest way to eliminate your debts. From the time your case is filed, it generally takes approximately four months for you to receive a discharge of your debts. Most debts can be eliminated, although there are certain obligations that cannot be discharged. The most common debts that remain after bankruptcy are child support, alimony, certain taxes, student loans, and criminal restitution and fines. However, many taxes, including some income tax over three years old, can be discharged. There are restrictions on who can file a Chapter 7. If you have above average income or have received a discharge in bankruptcy within the last eight years, you may not be eligible to file a Chapter 7.
Chapter 13 involves a schedule of monthly payments to your creditors, typically over three to five years. The amount of your payment is NOT determined by how much you owe, but rather by the amount of money you have left each month after paying a reasonable amount for your necessary living expenses, including housing, car payments, utilities, insurance, food, clothing, etc. Payments may actually be quite low. Higher income Debtors may be required to file a Chapter 13. Chapter 13 bankruptcies offer benefits not available in Chapter 7, including, in appropriate circumstances, the ability to eliminate second mortgages and reduce car payments to the market value of the vehicle. Chapter 13 is an excellent way to pay non-dischargeable tax debts without additional penalties and interest. Arrearages on house and car payments may also be made up in Chapter 13. However, if you are behind on your payments, the sooner you take action by filing bankruptcy, the lower and more affordable those payments will be. You may also be eligible for a Chapter 13, even if you have filed a Chapter 7 within the last eight years.
