In some cases, a Chapter 13 plan may pay just what a car or truck is worth if that is less than the full amount of the loan.
In addition, a debtor who runs up debt before filing a bankruptcy may find that one or more creditors may object to the discharge of their debts in a Chapter 7 case. The discharge in a Chapter 13 is broader and may enable a debtor to avoid civil fraud charges. However, bankruptcy may not be used to avoid prosecution when a crime has been committed.
